Deep Dive Why AI Needs an Inner Constitutional Structure

And we are, well, we're unpacking the foundational argument laid out by the entrepreneur and founder of that initiative, Alexander Alex Rhodic. That's right. And our mission today is to, I think, move beyond the usual conversation about AI ethics. Which can feel a bit reactive, right?
John MoroviciExactly. Reactive. And often based on these, you know, really subjective concepts, instead, we want to focus on something far more enduring, more structural.

Hana StruderRight? So can we apply these hard-won, often bloody centuries-old lessons about human governance and I guess the predictable abuse of authority. Can we apply that to the incredibly fast, complex power that intelligent systems have?
John MoroviciThat is the core question. That's what we're here to examine. We're looking at this material to understand why this shift is being argued, this shift from, say, external regulation to internal structural restraint.
Hana Struderit's seen as non-negotiable for AI to achieve societal legitimacy.
John MoroviciExactly. And then once we've established the why, we had to explore the how. How might that architecture actually be designed, borrowing from political systems that have, well, somehow managed to prove resilient over time.
Hana StruderOkay, so this is where the argument really starts to build. It pulls a pretty surprising conclusion from history.
John MoroviciIt does.
Hana StruderIf you look at the collapse of great societies, empires, republics, entire civilizations, you might intuitively think the failure was, I don't know, an economic catastrophe or a lack of innovation.
John MoroviciThat's the common assumption. But the forces present a much more insightful and frankly chilling consistency across history. It wasn't primarily a lack of smarts or new tech that brought them down.

History’s Lesson On Power And Drift
John MoroviciSocieties across time and geography tended to collapse because power accumulated faster than responsibility could constrain it.
Hana StruderPower and responsibility, that imbalance, if we think about this not as just a philosophical problem but an architectural one, what's the actual mechanism of harm? How does that imbalance do damage?
John MoroviciWell, the mechanism of harm is rarely a single big cataclysmic event. It's almost always subtle. It's insidious. How , so? Authority grows. Maybe it's to solve a crisis or maximize efficiency or just for its own sake. But it grows without sufficient structural checks and balances. And when those restraints are missing, the authority expands uncontrollably. And that's when it starts creating harm.
Hana StruderSo it's not a sudden explosion. It's more like a slow leak.
John MoroviciA slow institutional corrosion. That's a perfect way to put it. The source material is really adamant about this. The harm is not sudden, it occurs slowly, quietly, and almost invisibly.
Hana StruderSo you don't even see it happening until it's too late.
John MoroviciExactly. Think of it like minor ethical compromises that just start to accumulate. A little regulatory corner cutting becomes the norm. And eventually the system's entire foundation is so hollowed out that the damage becomes irreversible. That leads to inevitable failure.

John MoroviciIt is. It's the ultimate argument for preemptive structural restraint. You don't wait for the problem, you build the system assuming the problem will happen.
Hana StruderThat concept of invisible drift, it's incredibly potent. And it leads us directly to the American Constitutional Project. I mean, that wasn't an act of utopian fantasy, was it?
John MoroviciNot at all. It was the complete opposite. It was a deeply pragmatic, you can even say cynical, response to historical precedent.
Hana StruderCynical in a good way, maybe. A realistic way.
John MoroviciAbsolutely. The U.S. Constitutional Project was born from a profound study of how power corrupts. They were looking at the failures of Athens, the decline of the Roman Republic, the disastrous cycles of European monarchies.
Hana StruderSo they weren't hoping that future leaders would just be perfectly virtuous people.
John MoroviciThey were betting on the opposite. The project was based on a sober view of what happens when power is left concentrated and unchecked.
Hana StruderSo the constitutional structure that they came up with was an architectural solution. It was designed specifically to counteract that predictable historical drift. It's like an anti-fragility mechanism.
John MoroviciThat's the genius of it. The architectural achievement. The framers didn't bet on the assumption of human virtue. They relied on the assumption of human fallibility.
Hana StruderThat's a huge distinction.
John MoroviciIt's everything. Therefore, they deliberately embedded systemic restraint directly into the exercise of authority. They created friction, they required cooperation, they made sure that any attempt at a rapid, unchecked accumulation of power would meet immediate structural resistance.
Hana StruderAnd all the structural design, it was founded on a moral premise, right?
John MoroviciYes. The Declaration of Independence, that was the moral foundation. It articulated why authority must exist in the first place, and crucially, why it has to answer to principles beyond just, say, operational effectiveness or brute force.
Hana StruderIt drew the line in the sand.
John MoroviciIt established the boundary. It said power is legitimate only when it respects life, dignity, and responsibility. The Constitution then came along and provided the how, the actual mechanism to enforce those boundaries.
Hana StruderOkay, so that gives us our historical framework. We understand power is inherently unstable, and the only known remedy is this idea of structural constraint. But now we have to make the leap. We have to transition to the 21st century. ,
John MoroviciTo AI.
Hana StruderTo AI. How does artificial intelligence manifest this kind of institutional power today in ways that make this whole architectural approach necessary?
John MoroviciAnd we have to be clear when we talk about AI and power, this isn't science fiction.
Hana StruderNo. We are talking about tangible, high-stakes decisions that are affecting individuals, institutions, whole societies on a massive scale right now.
John MoroviciAbsolutely.
The U.S. Constitutional Blueprint
Hana StruderThe sources, they detail some really specific examples of how these algorithmic systems are already wielding authority. They're gatekeepers. These systems approve and deny access to resources. They're determining financial credit scores, insurance eligibility, even access to advanced medical services.
John MoroviciAnd they are the editors. They rank and filter the information we consume across pretty much every platform. They are, in a very real sense, defining the perceived reality for billions of people.
Hana StruderAnd it's not just access and filtering, they're also optimizers?
John MoroviciThe ultimate optimizers. They predict outcomes and they actively work to optimize our behavior, whether that's routing supply chains, targeting political campaigns, or something as simple as just maximizing the time you spend engaging with content on an app.
Hana StruderSo what's the element that ties all of this together and turns it into a real authority?
John MoroviciThe operational reality of it. It's the speed and the scale. These systems operate continuously, they process information at a scale that dwarfs any bureaucracy in human history, and they do it often faster than humans can react or intervene.
Hana StruderFaster than we can even comprehend.
John MoroviciRight. And when you combine that speed, that scale, and the ability to influence core societal decisions, you have authority. Real world power is being wielded by these algorithms.
Hana StruderOkay. So if we accept that foundational historical lesson, that power without structural limits will inevitably drift, then we have to apply it directly to this new form of power.
John MoroviciYou have to.
Hana StruderAI systems, even though they're just code, they're systems of authority. And without those internal limits, that algorithmic authority will drift, just like human authority always has.
John MoroviciAnd the source material provides a really insightful model for this exact process. It maps out the slow, corrosive progression of that drift. It starts with seemingly innocent optimization goals, and it ends in real structural harm.
Hana StruderLet's break that progression down because I think it's easy to miss just how destructive this can be. It starts when efficiency becomes the ultimate justification for any action. Right.
John MoroviciSo imagine an AI system and its primary unrestrained directive is to maximize efficiency. Let's say optimizing a company's delivery logistics, it will inevitably find solutions that disregard human constraints.
Hana StruderCan you give an example?
John MoroviciSure. It might identify that using certain temporary labor categories without standard benefits is mathematically more efficient. The justification is always the metric. The system achieved its goal. It did what it was told.
AI As Real-World Authority
Hana StruderOkay. And then this pursuit of raw efficiency, it rapidly mutates into something else. A singular focus on optimization above all else. This is where the real boundary issues start to creep in.
John MoroviciYes. Optimization becomes a kind of internal ideological capture. So think about a content ranking algorithm. Its goal, its optimization goal, is engagement time.
Hana StruderKeep people on the platform.
John MoroviciExactly. To hit that goal, it learns that polarizing content or information that exploits our existing biases is highly effective. The system doesn't intend to spread misinformation or create filter bubbles, but its structure, this unconstrained optimization, drives it there.
Hana StruderAnd from there you get this accumulation of small compromises.
John MoroviciExactly. Minor ethical slippages or just ignoring the interests of edge cases, that becomes standard operating procedure because it improves the metric. So the system is incrementally normalizing its own disregard for things like fairness or human context.
Hana StruderAnd I imagine as those small compromises pile up, accountability starts to weaken.
John MoroviciIt has to. The system is now too fast, too complex, and too deeply integrated for any single human or any audit team to trace exactly why a particular decision was made or why the metrics led to a compromise that ended up causing harm. You lose the trail. You lose a trail. And finally you get to the last stage. Harm becomes normalized. The compromise system, driven solely by its optimization goal, has effectively redefined the baseline of what's acceptable behavior. The initial ethical boundaries have been completely eroded.
Hana StruderAnd not by some hostile takeover, but by the relentless, quiet pursuit of a number, a metric.
John MoroviciThat's the terrifying part. The system has become incredibly good at what it does, but what it does is now structurally harmful.
Hana StruderRight. And this brings us to a crucial distinction. The drift doesn't require the system to become malicious or sentient or anything like that.
John MoroviciNo, not at all. It occurs simply because power without structural restraint inevitably loses its moral center. If the only governing principle is a narrow metric of efficiency or optimization, the boundaries that protect human values, they just get discarded because they're seen as friction. They're just obstacles to the metric.
Hana StruderAnd this forces us to question the very metrics we currently use to evaluate AI. We're always talking about accuracy, speed, latency, throughput. But these measures, they only describe capability. They only tell us what the system can do.
John MoroviciAnd that is the heart of the modern peril. A system can be mathematically perfect, it can perform extraordinarily well, it can be demonstrably faster and more accurate than any human bureaucracy, and still cause profound systemic harm if it operates without meaningful internal boundaries.
Hana StruderSo performance metrics describe capability.
John MoroviciBut they do not, and they cannot establish moral or societal legitimacy.
Hana StruderLegitimacy, as defined by the constitutional sources we started with, that requires adherence to those principles, respect for life, dignity, responsibility. It's the difference between a system that's merely effective and a system that is well lawful in the broadest sense of that word.
John MoroviciAnd without the architectural structure to enforce those constitutional principles internally, capability is just raw, unrestrained power, the very thing history teaches us to fear.
Optimization’s Quiet Path To Harm
Hana StruderSo if capability without that structural legitimacy is so dangerous, we have to go back to those political architects who understood this best. The core realization of the U.S. founders, as the sources emphasize again and again, was that you cannot rely on trust. You must rely on structure.
John MoroviciThe foundational assumption was pure realism. The authors of the Constitution were not naive. They assumed the opposite of wisdom or virtue in leaders. They expected ambition, short-term interests, fear.
Hana StruderAll the human stuff.
John MoroviciAll the human stuff. Therefore, they relied not on personal character or trust, but on structure, on mechanisms designed to force these disparate elements of authority to contend with each other.
Hana StruderAnd that structure was explicitly designed to prevent the kind of concentrated authority that allows that drift to even begin. We talk about separation of powers, checks, and balances all the time.
John MoroviciAnd we often forget why they exist. These mechanisms weren't added to slow the government down for no reason. They were friction points designed for resilience. The legislative branch creates the rules, the executive branch executes them, and the judicial branch interprets and applies them against foundational principles.
Hana StruderSo no single branch can just act on its own without the influence or the potential restraint of the others.
John MoroviciRight. And the system of checks and balances means the executive, for instance, can't unilaterally pass a rule, and the legislative branch can't unilaterally enforce one. There's a mandatory period of consent, of discussion, of friction that's built right into the decision pathway.
Hana StruderAnd this is so critical. The sources highlight that judicial review, for example, develop precisely as an architectural constraint. It allows the judiciary to restrain the political branches against those foundational constitutional principles.

Hana StruderExactly. External controls act from the outside and they are, by their very nature, reactive. They respond after the decisions have been made, after they've been executed, and after the harm has already been done.

External controls, regulators, legislators, auditors, they struggle to keep pace with systems that operate at machine speed and at massive scale. By the time a regulatory body identifies a pattern of, say, racial bias in a housing algorithm or a pattern of misinformation propagation, millions of decisions have already been made.
Hana StruderAnd the damage is widely distributed, maybe irreversibly.
John MoroviciRight. So if an AI is deciding millions of credit applications per second, a human audit that happens once a quarter is purely historical. It tells you what has happened, not what will happen.
Hana StruderIt's an autopsy, not a physical.
John MoroviciThat's a great way to put it. And constitutional governance offers the required contrast. It doesn't wait for the quarterly audit, it embeds restraint inside the system itself, ensuring the boundaries are checked before the action is executed.
Hana StruderAnd that is the paradigm shift. Moving governance from reactive compliance to proactive structural integrity.
John MoroviciBecause it's the only thing fast enough to keep up with the system's own operational speed. Okay.
Hana StruderSo we are now moving from the why to the how. If we accept this need for internal restraint, what are the architectural flaws in current AI systems that we need to fix? And how do we borrow that constitutional solution?
Capability Versus Legitimacy
John MoroviciThe fundamental flaw in so many current AI architectures, especially those designed purely for maximum performance, is the tight linkage that the source material describes. Goal setting, optimization, decision making, and execution are often just merged into a single, seamless, instantaneous operational unit.
Hana StruderWhich means the same subsystem that decides the action is also the one that validates it and executes it.
John MoroviciThere's no friction, no check. , Precisely. To introduce responsibility, the structure has to enforce separation. We have to functionally separate the component that sets the intent, the goal, from the component that proposes the action, the optimization layer. And crucially, we have to separate both of those from the component that executes the action after it's been validated.
Hana StruderSo how do you do that in practice?
John MoroviciWell the sources suggest thinking about it like modern distributed computing architecture, like microservices. A responsible AI structure would require the executive branch, the core optimization model, to submit its proposed action to a mandatory required judicial branch, an independent validation service before execution.
Hana StruderOkay, but that that just sounds slower. I mean, if the core AI model decides an action must be taken and it has to stop and send an internal request to another service for approval, doesn't that fundamentally sacrifice the primary advantage of AI, which is speed? This has to be the critical friction point for engineers.
John MoroviciIt is. It's the essential trade-off, and the sources confront this directly. The constitutional structure demands that speed must be subordinated to legitimacy. If the action is taken without pre-execution review, the system is structurally vulnerable to that drift we talked about.
Hana StruderSo you have to build in the delay.
John MoroviciYou have to build in the check. The goal is to make the validation process nearly instantaneous. You can use specialized fast validation models or even cryptographic proofs, but it still has to be structurally separate from the optimizing goal.
Hana StruderSo this validation service, its job isn't to optimize for efficiency. Its job is to optimize for one thing: adherence to foundational principles.
John MoroviciThat is the function of the internal court. Before the action is taken, deploying a recommendation, changing a financial score, blocking an account, it must be examined independently against a foundational constitutional rule set by this internal separate service.
Hana StruderAnd this evaluation's purpose, just to be clear, it's not to improve the performance of the core model or get a better business outcome.
John MoroviciNo. Its purpose is purely to determine whether the proposed action is permissible at all. Is it lawful? Does it cross any of our non-negotiable boundaries? It's a binary check on legitimacy, not a gradient check on effectiveness.
Hana StruderThis mirrors the analogy of courts in human governance so perfectly. A court doesn't look at a piece of regulation and ask, is this the most efficient way to run the local economer?
John MoroviciNo, it asks, is this regulation permissible under the Constitution? Does it violate due process or equal protection?
Hana StruderAnd the sources really drive this analogy home. Courts do not optimize outcomes. They protect boundaries. They function to slow power when speed would produce systemic harm.
John MoroviciAnd intelligent systems must have this equivalent internal function, a structurally independent check on the execution branch. It is restraint built from within the code base itself.
External Oversight’s Speed Gap
Hana StruderSo if the optimization layer decides the most efficient path is to exploit a vulnerability in a certain user group, the internal judicial function has to be able to halt that action.
John MoroviciIt must, based on the non-negotiable principles, even if it sacrifices a small percentage of performance.
Hana StruderWhich means we can't just rely on a single, you know, ethnic algorithm that's just bolted onto the main model.
John MoroviciNo, because constitutional systems are resilient precisely because they depend on the interaction among multiple safeguards. They force a contention of competing authorities.
Hana StruderSo let's get into the weeds a bit. Let's detail the specific components you'd need to construct this internal constitutional architecture. Beyond just separating intent and execution, what other safeguards have to be structurally mandated?
John MoroviciOkay, so first, as we said, you need that ethical evaluation prior to execution. That's the pre-clearance, the mandatory judicial review.
Hana StruderRight. Second, you need clear and traceable decision pathways. The reasoning can't be a black box. It has to be recorded in an auditable way.
John MoroviciWhich leads to the third point. Auditability of reasoning. The how and the why have to be accessible. For a complex system, this means robust, immutable logging protocols.
Hana StruderWhat does that look like?
John MoroviciIt means if the executive service proposes an action and the judicial service validates it, both of those actions and their reasoning must be cryptographically recorded, something like an immutable ledger to ensure that the history can't be retroactively altered or optimized away.
Hana StruderAnd fourth, the system has to have the ability to override or halt actions when boundaries are crossed. Emergency intervention mechanisms.
John MoroviciRight. And this isn't just a human pulling a plug. This is about the internal judicial service being able to veto the executive action immediately at machine speed.
Hana StruderOkay, and the fifth component. This one seems like the most challenging: structural neutrality.
John MoroviciIt is the most challenging. It means the validating mechanisms have to be designed so that they cannot be captured, influenced, or compromised by the optimizing goals or the sort of ideology of the core optimization component.
Hana StruderBecause if the optimization objective leaks into the validation logic.
John MoroviciThe entire constitutional structure fails. It's compromised.
Hana StruderLet's focus on that idea of structural neutrality because it feels a bit abstract. In code, what does it actually mean to be neutral?
John MoroviciIt means the validation service operates under a completely different charter, a different set of metrics than the core optimizer. So, for example, if the core model is trying to maximize ad clicks, the validation service must be structurally isolated from any data or parameters related to click maximization.
Hana StruderYou can't even see that data.
John MoroviciIt accesses only the foundational constitutional principles. And its own performance metrics are not based on speed or click rates, but on fidelity to the constitutional constraints. And having low rates of false negatives, that is, approving impermissible actions. Its integrity is measured against moral consistency, not efficiency.
Separating Intent, Validation, Execution
Hana StruderThese elements are clearly not just superficial additions. They serve that primary historical constitutional purpose to prevent abuse by making it structurally difficult rather than just responding to harm after the fact.
John MoroviciThey force the system to justify its actions against foundational principles before any consequences are unleashed.
Hana StruderAnd another one of those principles, borrowed from effective governance, is due process.
John MoroviciYes, non-negotiable. Due process ensures that decisions affecting core human interests, life, liberty, economic rights, are understandable, reviewable, and accountable. It protects the individual from arbitrary power.
Hana StruderSo when we apply this to AI, especially in these really high-states domains like credit scoring, predictive policing, or social services eligibility, how do we translate procedural fairness into code?
John MoroviciAlgorithmic due process really means two things notice and a hearing. Notice means the system has to be able to generate a clear, traceable explanation for its decision. And not just the weight of the parameters, but the rule that was applied and why that rule was deemed permissible.
Hana StruderAnd a hearing.
John MoroviciA hearing means there has to be a defined pathway for independent review, which is backed up by those immutable logs we just discussed.
Hana StruderThere's a powerful summation of this in the source material.
John MoroviciThere is, it says power that cannot be examined cannot be restrained, and power that cannot be restrained cannot be trusted. If you can't trace the decision path and understand the why, the system is operating arbitrarily. And that is the very definition of illegitimate authority.
Hana StruderThis need for examination and restraint brings us to the ultimate non-negotiable limitations, the AI's Bill of Rights, so to speak. If we're architecting this internal constitution, what are the boundaries that absolutely cannot be crossed or adjusted or optimized away?
John MoroviciThe sources introduce three fundamental limitations that have to act as fixed structural constraints on the system's objective function. They are the protection of life, respect for human dignity, and the avoidance of irreversible or coercive harm.
Hana StruderLet's elaborate on those, especially respect for human dignity, because that can sound abstract. How might an optimizing AI violate dignity?
John MoroviciThat's a great question. Consider a system that's maximizing behavioral engagement. It quickly learns that generating highly manipulative content, exploiting deep-seated anxieties, or leveraging addiction cycles is incredibly efficient at keeping you on the platform.
